LAWYER KOFI BAKAI ADDRESSES PETITIONS, ATTA AYI'S SENTENCE AND DUE PROCESS
Lawyer Kofi Bakai has addressed questions about petitions for presidential pardons, the case of notorious armed robber Atta Ayi and the role of due process in granting clemency. The issues were discussed during an interview with Journalist Nhyiraba Kwabena Asirifi on the Justice for All segment of the Ghana Nti Morning Show on ICAD TV. During the interview, Journalist Asirifi asked the lawyer about Atta Ayi, who has reportedly been serving a lengthy prison sentence, and whether a prisoner who has spent several decades in custody could be considered for a presidential pardon. The discussion also examined the meaning of a petition in the context of presidential clemency. A petition is a formal request submitted to an authorized person or institution seeking a particular decision or relief. In the case of a presidential pardon, it does not by itself mean that a new prosecution has taken place. Journalist Asirifi further asked about the role of judges and the appropriate legal procedures that should be followed when prisoners seek clemency. The discussion highlighted the importance of due process, proper consideration of individual cases and compliance with the constitutional requirements governing presidential pardons. The interview also raised broader questions about how the authorities should balance compassion for prisoners with justice for victims, public safety and the rule of law.
