LAWYER KOFI BAKAI EXPLAINS ABU TRICA'S COURTROOM PROCEEDINGS

Lawyer Kofi Bakai has explained the legal process surrounding the extradition proceedings involving Frederick Kumi, popularly known as Abu Trica, following the dismissal of his legal challenge by the Accra High Court. Speaking in a phone interview with Nana Nhyiraba Kwabena Asirifi on the Ghana Nti Morning Show, Lawyer Bakai discussed why Abu Trica remained in custody despite issues surrounding bail during the extradition process. According to him, when a foreign country seeks the extradition of a suspect, it must present the necessary legal documents and evidence before the court in the country where the individual is located. In this case, he explained, the United States is required to satisfy the Ghanaian court that the legal requirements for extradition have been met. Lawyer Bakai noted that the person sought for extradition has the right to challenge the application in court. However, he explained that even where bail is considered or granted during proceedings, the court may still order that the individual remain in custody if it believes detention is necessary to ensure the extradition process is completed and to prevent interference with ongoing legal proceedings. He further stated that once the court determines that the legal requirements for extradition have been satisfied, the relevant authorities can proceed with transferring the individual to the requesting country in accordance with the law. Lawyer Bakai concluded that decisions on bail and custody in extradition matters are based on legal procedures and the specific circumstances of each case, with the courts ultimately determining whether a person should remain in custody while the extradition process is finalized.
